What is EB-1A?

Basic Eligibility Logic

 EB-1A is an immigrant category for individuals who can prove with documents that they compete at a high level within their professional field and demonstrate results stronger than the majority of their peers.

This category is not based on job title or years of experience.

USCIS evaluates achievements, recognition, and professional impact, supported by evidence.

To be accepted for review, an applicant must:

  • meet at least 3 out of 10 formal criteria established by USCIS; and
     
  • submit documentation that collectively demonstrates a professional level above the industry average.
     

Important:

the criteria are not abstract descriptions but document-based categories.

Each criterion must be supported by verifiable evidence, such as awards, publications, judging activities, income records, leading roles, implemented contributions, or recognition from industry peers.

After the initial criteria review, the officer evaluates the petition as a whole and determines whether the evidence shows that the applicant:

  • genuinely stands out in their field;
     
  • continues to work in the same professional area; and
     
  • seeks entry to the United States to continue that professional activity, not to change fields.
     

For EB-1A, the decisive factor is not the volume of documents, but their structure, logic, and evidentiary strength.
